Welcome to MarsX

These Terms of Service (the “Terms”) govern your access and use of the MarsX website (https://marsx.io), the MarsX metaverse game (the “Game”), and any related content, services, or functionalities available through the website and the Game (collectively, the “Services”). The Services are operated by or on behalf of Skyland Information Technology LLC (“MarsX,” “we,” or “us”).

Please read these Terms carefully as they contain important information regarding your legal rights. By using or accessing the Services, you agree to comply with and be bound by these Terms. If you do not understand or agree to these Terms, you must not use the Services.

1. Services, Wallets, and Accounts

Description of Services

MarsX provides a unique multiplayer metaverse experience where players explore, colonize, and build sustainable civilizations on Mars. The MarsX metaverse integrates blockchain technology with two primary tokens:

  • * MX Token:The in-game currency used for economic activities, including trading, resource acquisition, and upgrades.
  • * Opal:A rare, valuable in-game resource central to MarsX’s narrative and economy, used for premium transactions and strategic objectives.

The governance of MarsX is handled by the MarsX Decentralized Autonomous Organization (DAO). While we may provide services to support the DAO, we do not control the MarsX DAO and are not responsible for its decisions.

Decentralized Autonomous Corporations (DACs)

Players may form Decentralized Autonomous Corporations (DACs) to work collaboratively within the MarsX metaverse. DACs are autonomous, guild-like factions with voting and decision-making governance structures. We reserve the right to revoke access to DAC tools if a DAC or its members violate these Terms.

Game Items

The MarsX Marketplace allows players to purchase, trade, and sell in-game assets such as land parcels, resources, and other items.Soulbound Items are non-transferable and permanently linked to a player’s account. MarsX does not guarantee the future value, functionality, or utility of any in-game assets.

Game NFTs

Some in-game items may include Non-Fungible Tokens (NFTs), tracked on the MarsX blockchain. These NFTs confer ownership of in-game assets, but players are responsible for any blockchain-related transaction fees. MarsX does not provide refunds for NFT transactions once completed.

Marketplace Transactions

Players can conduct peer-to-peer transactions in the MarsX Marketplace. Transaction fees apply, which can be reduced by staking MX Tokens. MarsX is not responsible for transactions conducted outside the MarsX ecosystem or on third-party platforms.

Digital Wallets

To engage with the Services, players must connect a non-custodial wallet that is compatible with MarsX. Players are solely responsible for securing their wallets and private keys. MarsX is not liable for wallet-related losses, including unauthorized access or technical issues.

2. Location of Our Privacy Policy and Other Terms

The MarsX Privacy Policy outlines how we collect, use, and protect your data when using the Services. For further information on our privacy practices, please visit our Privacy Policy page. By using the Services, you also agree to abide by any additional terms related to the Services, such as community guidelines or marketplace policies.

3. Eligibility; Rights We Grant You; Usage Limitations

Eligibility

You must be at least 13 years old to use the Services. If you are a minor (under the age of 18), you must have permission from a parent or guardian. Certain aspects of the Services may have additional age restrictions. By using the Services, you also affirm that you are not prohibited from accessing MarsX based on any legal restrictions, such as trade sanctions or listings on denied persons' lists

User Account

To access certain features of the Services, you may be required to create a user account. You are responsible for providing accurate, complete information and for maintaining the confidentiality of your account credentials. You are liable for all activities conducted through your account.

License Grants

MarsX grants you a non-exclusive, non-transferable, revocable license to access and use the Services for personal use. All intellectual property associated with the Services, including software, graphics, and game assets, remains the property of MarsX.

4. Ownership and Content

Ownership of Services

All elements of MarsX, including graphics, game assets, and software, are protected by intellectual property laws. MarsX retains all ownership rights to these assets, and users are granted limited licenses for personal use. You may not copy, modify, distribute, or create derivative works based on MarsX assets unless explicitly permitted by these Terms.

User-Generated Content

By submitting content to MarsX, you grant us a worldwide, royalty-free license to use, display, modify, and distribute your content for the purpose of operating the Services. You represent that you own or have the necessary permissions to grant such a license.

5. Third-Party Services and Materials

The Services may include links to third-party websites or resources. MarsX does not endorse or assume responsibility for the content, privacy practices, or other policies of third-party services. You acknowledge that MarsX is not liable for any damages or losses caused by your use of third-party services.

6. Updates and Patches

MarsX may provide updates, patches, or modifications to the Services. These updates may occur without prior notice and are necessary to maintain the Services. You agree that MarsX may modify, suspend, or discontinue features of the game at any time.

7. Termination

MarsX reserves the right to terminate your account or access to the Services at any time, with or without notice, if you violate these Terms or engage in any disruptive or prohibited behavior. Upon termination, any licenses granted to you will be revoked, and you must cease using the Services.

8. Disclaimers; Limitations of Liability; Indemnification

Disclaimers

MarsX provides the Services on an “as is” and “as available” basis. We do not guarantee uninterrupted access to the Services and disclaim any warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

MarsX will not be liable for any indirect, special, incidental, or consequential damages arising from your use of the Services. Our total liability for any claim will not exceed the amount you paid to MarsX in the previous six months or $100, whichever is greater.

Indemnification

You agree to indemnify and hold MarsX harmless from any claims, damages, or losses arising out of your use of the Services, your violation of these Terms, or your infringement of any rights of a third party.

9. Governing Law; Arbitration; Class Action Waiver

Governing Law

These Terms are governed by the laws of the United Arab Emirates. Any disputes arising from these Terms will be subject to binding arbitration, except for claims that qualify for small claims court or injunctive relief.

Arbitration and Class Action Waiver

All disputes between you and MarsX must be resolved through arbitration. By agreeing to arbitration, you waive the right to participate in class-action lawsuits. You have the right to opt out of arbitration within 30 days of agreeing to these Terms by submitting a written notice.

10. Additional Provisions

Changes to Terms

MarsX may modify these Terms at any time. Updated Terms will be posted on our website, and your continued use of the Services constitutes acceptance of any changes.

Export Compliance

Users must comply with UAE export laws and may not use MarsX in countries subject to trade sanctions.

Force Majeure

MarsX will not be held liable for delays or failures caused by events outside of its control, such as natural disasters, war, or cyberattacks.
